1. Introduction and Legal Effect

These Terms & Conditions ("Terms") form a legally binding agreement between BROKKET TECHNOLOGIES PVT. LTD. ("Brokket", "Company", "we", "our" or "us") and every person, firm, company, representative, employee, broker, channel partner, real estate professional, builder, developer, advertiser, viewer, visitor or account holder who accesses or uses the Brokket website, mobile application, Circle feature, listings, projects, downloads, academy, news, communication tools and related digital services (collectively, the "Platform").

This document is an electronic record under the Information Technology Act, 2000 and applicable rules. It does not require physical or digital signatures. By accessing, browsing, registering on, uploading content to, or otherwise using the Platform, you confirm that you have read, understood and agreed to these Terms, together with the Brokket Privacy Policy and any other policy displayed or made available through the Platform.

If you are using the Platform on behalf of a company, partnership firm, proprietorship concern, real estate brokerage, developer, builder, agency or other entity, you represent that you have authority to bind that entity to these Terms. In such cases, references to "you" and "user" include both you individually and the entity on whose behalf you use the Platform.

2. About Brokket

Brokket is a professional real estate technology platform created to support real estate professionals with structured information, professional networking, collaboration, education and productivity tools. The Platform may include project information, property-related posts, real estate listings, professional profiles, Circle networking posts, images, videos, comments, downloadable resources, training content, updates, communication tools and related services.

Brokket is not a real estate broker, real estate agent, developer, builder, coloniser, financial advisor, investment advisor, legal advisor, tax advisor, escrow agent, payment intermediary or party to any property transaction. Brokket provides a digital environment where users may access information and interact with one another, but decisions, negotiations, representations, commitments, site visits, payments, commissions, brokerage sharing, documentation and transactions remain solely between the concerned users and third parties.

Brokket does not guarantee that any user, listing, project information, opportunity, document, property detail, price, availability, commitment, representation or business communication available through the Platform is accurate, complete, lawful, updated, verified, commercially suitable or transaction-ready.

3. Eligibility and User Capacity

The Platform is intended only for users who are at least 18 years of age and legally capable of entering into a binding contract under applicable law. By using the Platform, you represent and warrant that you are at least 18 years old, competent to contract, and using the Platform for lawful professional, business, informational or permitted personal purposes.

Individuals below the age of 18 are not permitted to create an account, post content, communicate with other users or use the Platform. Brokket may suspend or terminate any account if it believes that the account is being used by a minor or by a person who is not legally competent to accept these Terms.

You also represent that you are not prohibited under any applicable law, regulatory order, court order, contractual obligation or professional restriction from accessing or using the Platform.

4. Account Registration and Accuracy of Information

To use certain features of the Platform, you may be required to create an account and provide information such as your name, mobile number, email address, company name, firm details, professional role, city, profile information, business identity, RERA-related details or other information requested by Brokket.

You agree to provide true, accurate, complete and updated information at all times. You must not create an account using false information, fake identity, another person's name, misleading business details, unauthorised company information, forged documents, false RERA credentials, fake photographs or impersonated professional profiles.

You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. If you suspect unauthorised access, misuse or security compromise, you must promptly notify Brokket through the contact details provided in these Terms.

5. User Verification and Platform Trust

Brokket may, at its discretion, request identity, business, professional, firm, regulatory or other verification information before or after allowing access to certain features. This may include firm-level information, employee association, business address, professional details, RERA-related information, mobile verification, email verification or other information relevant to platform trust and user safety.

Verification, badges, approval status or similar indicators, if displayed, are intended only to improve platform trust and user experience. They do not constitute a guarantee by Brokket regarding the verified user's honesty, competence, legality, title, financial capacity, business quality, regulatory status, transaction capability, professional performance or future conduct.

Brokket may approve, reject, review, suspend, revoke or modify verification status at any time if information appears inaccurate, incomplete, suspicious, outdated, disputed, unlawful or inconsistent with these Terms.

6. Scope and Nature of Services

The Platform may provide access to real estate project information, property-related listings and posts, professional networking, Circle posts and comments, educational or training content, downloadable business resources, industry updates, city or project insights, communication features, profile pages and other digital tools created for real estate professionals.

Brokket may add, remove, modify, restrict, redesign or discontinue any feature at any time to improve performance, safety, compliance, reliability, user experience or business operations. The availability of a feature on one device, operating system, city, user category or account type does not guarantee its availability to every user.

Certain content may be curated by Brokket, while other content may be uploaded, posted or shared by users. Users must carefully distinguish between platform-provided informational resources and user-generated content. Even where information appears on the Platform, users must independently verify its accuracy before relying on it.

7. Professional Use and User Conduct

Brokket is built for a professional real estate ecosystem. Users are expected to act with integrity, honesty, responsibility and respect while using the Platform. Users must not use the Platform in a manner that harms Brokket, other users, clients, property owners, builders, developers, real estate firms, regulatory authorities or the public.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not upload false listings, misrepresent property availability, circulate fake project information, claim unauthorised mandates, misuse photographs, forge documents, manipulate prices, mislead buyers or brokers, abuse the Circle feature, or use the Platform to damage another person's reputation or business.

Brokket may take action against conduct that is unprofessional, unsafe, unlawful, abusive, misleading or inconsistent with the purpose of the Platform, even if the conduct is not specifically listed in these Terms.

8. Circle - Professional Networking and Social Features

Circle is a social and professional networking feature within Brokket that may allow users to create profiles, publish posts, upload images and videos, comment, like, follow, connect, share updates, participate in discussions, view professional content and interact with other users.

Circle is intended for professional real estate networking, industry discussion, knowledge sharing, collaboration, recruitment-related updates, business communication and community building. It must not be used as a platform for obscene material, adult content, harassment, bullying, political abuse, personal attacks, unlawful promotions, spam, fake identities, fraudulent schemes or non-professional conduct.

All views, opinions, claims, recommendations, endorsements, comments, media, representations and communications posted by users on Circle are those of the respective users. Brokket does not endorse, verify, approve or accept responsibility for user opinions or user-generated content posted through Circle.

9. User-Generated Content

The Platform may allow users to create, upload, publish, display, transmit, share or distribute content including posts, property listings, comments, images, videos, documents, business information, profile information, messages, opinions, requirements, offers, availability updates, market observations and other material ("User Content").

You retain ownership of your User Content, subject to the rights granted to Brokket under these Terms. You are solely responsible for your User Content and for the consequences of uploading, publishing, transmitting or sharing it. You must ensure that your User Content is accurate, lawful, authorised, professional and does not violate any third-party right.

Brokket is not obligated to pre-screen User Content and does not guarantee that User Content is accurate, complete, lawful, appropriate, verified or reliable. Any reliance on User Content is at the user's own discretion and risk.

10. User Content Representations and Warranties

By uploading or sharing User Content, you represent and warrant that you have all rights, permissions, consents, licences and authority necessary to upload, publish, display and share such content through the Platform.

You further represent that your User Content does not infringe intellectual property rights, privacy rights, publicity rights, contractual rights, confidentiality obligations, trade secrets, regulatory duties, property owner rights, developer rights, builder rights, client rights or any other legal rights of any person or entity.

You confirm that your User Content does not contain false, misleading, fraudulent, defamatory, obscene, unlawful, harmful, threatening, hateful, discriminatory, sexually explicit, violent, exploitative, spam-like, malicious or unauthorised material.

11. Licence Granted to Brokket for User Content

By uploading, posting, submitting or sharing User Content on the Platform, you grant Brokket a limited, worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, process, adapt for technical formatting, display, publish, distribute, transmit, make available and otherwise use such User Content for operating, maintaining, securing, moderating, improving, promoting and providing the Platform.

This licence allows Brokket to show your content to other users, format it for different devices, create previews or thumbnails, store backups, use content for internal safety review, investigate complaints, and display content in connection with Platform features. This licence does not transfer ownership of your User Content to Brokket.

You may delete certain User Content where Platform functionality allows. However, copies may remain in backups, logs, screenshots, moderation records, cached systems, legal records, user shares, communications or locations where deletion is not technically or legally immediate.

12. Strictly Prohibited Content

Users must not upload, post, publish, display, transmit, distribute, promote or make available any content that is illegal, unsafe, harmful, abusive, deceptive or inconsistent with the professional purpose of the Platform.

  • Obscene, pornographic, sexually explicit, indecent, nude, adult, vulgar or sexually suggestive content.
  • Content involving sexual exploitation, abuse, grooming, endangerment or inappropriate depiction of minors.
  • Hateful, discriminatory or abusive content targeting religion, caste, race, ethnicity, nationality, gender, disability, age, sexual orientation or other protected characteristics.
  • Harassment, bullying, intimidation, threats, stalking, personal attacks, blackmail, extortion or doxxing.
  • Graphic violence, glorification of violence, dangerous activities, terrorism, extremism or criminal conduct.
  • False, misleading, deceptive, manipulated or fraudulent information, including fake listings, fake project updates and forged property documents.
  • Content infringing copyrights, trademarks, designs, database rights, trade secrets, publicity rights, privacy rights or contractual rights.
  • Malware, viruses, malicious code, phishing links, credential theft, unauthorised tracking, scraping tools or attempts to compromise platform security.
  • Spam, repetitive promotional abuse, unauthorised bulk messaging, artificial engagement manipulation or activity intended to mislead users or systems.
  • Content that violates any applicable law, court order, government direction, regulatory requirement or public order obligation.

13. Obscene, Adult and Sexually Explicit Material

Because Brokket includes Circle and other user-generated content features, users are expressly warned that obscene, pornographic, sexually explicit, adult, nude, vulgar, indecent or sexually suggestive content is strictly prohibited on the Platform.

If any user uploads, shares, forwards, comments on, stores, solicits, promotes or distributes such content, that user shall be solely responsible for all civil, criminal, regulatory, reputational and other consequences arising from such conduct. Brokket may remove such content, suspend or terminate the account, preserve relevant records and report the matter to competent authorities where required or appropriate.

Brokket may use human review, automated tools, keyword filters, user reports, content restrictions or other safety measures to detect and reduce objectionable content, but no system can guarantee that every violation will be prevented before it appears.

14. Misrepresentation, Impersonation and Fake Profiles

Users must not impersonate any individual, broker, employee, firm, company, builder, developer, government authority, regulator, client, buyer, seller, property owner, public figure or Brokket representative.

Users must not create fake accounts, duplicate accounts for abusive purposes, misleading business profiles, unauthorised firm pages, fake employee identities, forged verification details or profiles intended to deceive other users.

Brokket may request clarification, supporting documents or confirmation from a user or firm if a profile appears inaccurate, disputed, misleading or unauthorised. Failure to provide satisfactory clarification may result in restriction, suspension or termination.

15. Property Listings and Real Estate Information

Any property-related information uploaded or shared by users, including price, availability, area, specifications, images, floor plans, ownership claims, builder details, legal status, approvals, possession timelines, construction status, commission terms, mandates, documents or transaction representations, is the sole responsibility of the user who provides it.

Brokket does not independently guarantee property ownership, title, possession, price, availability, approvals, statutory compliance, document authenticity, encumbrance status, suitability, construction quality, builder performance, developer commitments, authority permissions or transaction completion.

Users must independently verify all property information through appropriate due diligence, site inspections, owner confirmations, builder confirmations, legal checks, regulatory records, title documents, professional advisors and competent authorities before relying on any information or entering into any transaction.

16. Project Information, Downloads and Educational Content

Brokket may provide project information, city information, market updates, downloadable resources, maps, templates, educational videos, academy content, news, insights and professional guidance. Such content is provided for general informational and professional learning purposes only.

Brokket makes reasonable efforts to maintain useful information, but does not warrant that project details, timelines, approvals, layouts, documents, maps, specifications, market updates or educational material are always accurate, complete, current or suitable for a particular transaction or decision.

Users should not treat Platform content as legal, financial, tax, investment, valuation, architectural, regulatory or professional advice. Users should seek advice from qualified professionals before making legal, financial, investment or transaction decisions.

17. No Role in Transactions, Brokerage or Commissions

Brokket is not a party to any real estate transaction, site visit, negotiation, booking, token payment, commission arrangement, brokerage sharing, referral arrangement, builder-broker agreement, buyer-seller agreement, lease, sale deed, allotment, cancellation, refund, dispute or settlement between users or third parties.

Any discussion, commitment, representation, pricing, brokerage understanding, commission sharing, customer introduction, mandate, property inspection, documentation, payment, refund or transaction outcome occurs solely between the concerned parties. Brokket has no control over and assumes no responsibility for such arrangements.

Users are responsible for complying with all laws, registrations, licences, disclosures, tax obligations, RERA obligations, professional duties and contractual commitments applicable to their business activities.

18. Communications Between Users

The Platform may allow users to communicate through posts, comments, messages, contact details, calls, links or other interaction tools. Users must communicate professionally, lawfully and respectfully.

Brokket does not guarantee that a user will respond, act honestly, complete a transaction, honour a commitment, maintain confidentiality, pay commission, share accurate information or behave professionally. Users should exercise caution before sharing sensitive business, financial, personal, customer or property information with others.

Brokket may review, restrict or preserve communications where required for safety, support, complaint handling, legal compliance, platform integrity or enforcement of these Terms, subject to the Privacy Policy and applicable law.

19. Reporting, Blocking and User Safety

Users may report content, accounts, profiles, messages, listings or activity that they believe violates these Terms, applicable law, professional standards or community safety expectations. Reportable issues may include obscene content, harassment, fraud, fake listings, impersonation, spam, intellectual property infringement, privacy violations, abusive behaviour, unlawful content or suspicious activity.

Where Platform functionality permits, users may block or restrict interactions with other users. Blocking may reduce visibility or interaction but may not remove all historical content, third-party screenshots, shared communications or records retained for legal and safety purposes.

Brokket may review reports and take action it considers appropriate, including no action, warning, content removal, visibility limitation, feature restriction, temporary suspension, permanent termination or escalation to competent authorities.

20. Content Moderation and Enforcement

Brokket reserves the right, but is not obligated, to monitor, review, screen, filter, restrict, remove, refuse publication of, disable access to or preserve any content or account activity that violates these Terms, applicable law, platform policies, safety requirements or the professional purpose of the Platform.

Moderation decisions may be based on user reports, automated tools, internal review, legal notices, regulatory directions, risk signals, user history or business judgment. Brokket may act without prior notice where necessary to protect users, prevent harm, comply with law, preserve evidence or maintain platform integrity.

Brokket's decision to allow, remove or restrict any content does not mean Brokket endorses such content, accepts liability for it, or waives its rights to take later action.

21. Repeat Violations and Account Termination

Users who repeatedly violate these Terms, upload prohibited content, engage in abusive conduct, create fake profiles, post misleading listings, misuse Circle, harass others, infringe rights, manipulate the Platform or create legal or safety risks may be permanently removed from the Platform.

Brokket may take one or more enforcement actions, including warning, content removal, reduction of visibility, restriction of posting, restriction of comments, restriction of messaging, disabling of features, temporary suspension, permanent termination, refusal of future registration or reporting to competent authorities.

In serious cases, including obscene content, child safety concerns, fraud, threats, unlawful activity, malware, impersonation or repeated abuse, Brokket may act immediately without notice.

22. Intellectual Property of Brokket

All rights, title and interest in the Platform, including software, source code, object code, user interface, design, layout, databases, algorithms, workflows, compilation, trademarks, trade names, logos, icons, brand assets, project organisation, content structure and other materials owned or licensed by Brokket, remain the property of BROKKET TECHNOLOGIES PVT. LTD. or its licensors.

Users are granted only a limited, revocable, non-exclusive, non-transferable permission to access and use the Platform in accordance with these Terms. No ownership rights are transferred to users.

Users must not copy, reproduce, modify, translate, distribute, sell, rent, lease, sublicense, reverse engineer, scrape, extract, mirror, frame, commercially exploit or create derivative works from any part of the Platform without Brokket's prior written permission.

23. Intellectual Property Complaints

If any person believes that content available on the Platform infringes their intellectual property rights, they may submit a written complaint to Brokket with sufficient information to identify the allegedly infringing content, the rights claimed, ownership or authorisation details, contact information and a statement that the complaint is made in good faith.

Brokket may remove or disable access to allegedly infringing content while reviewing a complaint. Brokket may also request additional information from the complainant or the user who posted the content.

Users who repeatedly upload infringing content may face restrictions, suspension or termination. False or misleading complaints may themselves result in action where appropriate.

24. Privacy, Personal Information and Confidentiality

Collection, use, storage, disclosure and protection of personal information are governed by the Brokket Privacy Policy. By using the Platform, you consent to the data practices described in the Privacy Policy.

Users must not upload or share personal information of others without lawful basis, consent or authority. This includes phone numbers, addresses, identification documents, private messages, customer data, buyer details, seller details, employee details, financial information or confidential business records.

Users are responsible for protecting confidential information shared through their account. Brokket is not responsible for losses arising from a user voluntarily sharing confidential, personal, business or transaction information with other users.

25. Communications Consent

By registering on or using the Platform, you consent to receive service-related communications from Brokket through email, telephone, SMS, in-app notifications, push notifications, messaging platforms or other communication channels provided by you or enabled through the Platform.

Service-related communications may include account verification, security alerts, platform updates, moderation notices, support responses, policy updates, feature information, content reports, operational messages and other communications connected with Platform use.

Users may opt out of non-essential promotional communications where permitted by law, but Brokket may continue to send important transactional, security, policy and service communications.

26. Restrictions on Technical Misuse

Users must not interfere with, damage, disrupt, overload, reverse engineer, decompile, attack, test vulnerabilities without authorisation, bypass access controls, scrape data, harvest user information, use bots, manipulate rankings, create artificial engagement, or attempt unauthorised access to the Platform, servers, systems, databases, APIs or accounts.

Users must not upload malware, spyware, viruses, worms, trojans, ransomware, malicious scripts, phishing links, credential harvesting forms or any code intended to compromise security or interfere with Platform operation.

Brokket may monitor suspicious technical activity and take action to protect the Platform, users, systems, data and business operations.

27. Third-Party Links, Services and Integrations

The Platform may contain links to third-party websites, maps, videos, documents, social platforms, messaging services, external pages, developer pages, government portals, builder websites, project pages, analytics tools or other third-party resources.

Brokket does not control and is not responsible for the content, policies, security, availability, accuracy, legality or practices of third-party services. Accessing third-party links is at the user's own risk and may be subject to separate terms and privacy policies.

The presence of a third-party link or reference on the Platform does not imply endorsement, verification, partnership or responsibility unless expressly stated by Brokket in writing.

28. Disclaimers and No Warranties

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Brokket disclaims all warranties, whether express, implied, statutory or otherwise, including warranties of accuracy, availability, reliability, merchantability, fitness for a particular purpose, non-infringement, security and uninterrupted operation.

Brokket does not warrant that the Platform will be error-free, virus-free, continuously available, compatible with every device, free from unauthorised access, or that defects will always be corrected immediately.

Brokket does not warrant that any user interaction, listing, project information, post, content, lead, collaboration, opportunity, training, download, communication or business outcome will be successful, profitable, lawful, accurate or suitable for any user.

29. Limitation of Liability

To the maximum extent permitted by applicable law, Brokket, its directors, officers, employees, consultants, affiliates, partners, licensors and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive or business losses arising out of or related to use of or inability to use the Platform.

Brokket shall not be liable for user disputes, failed transactions, incorrect listings, misleading property information, user misconduct, loss of business, loss of goodwill, loss of profits, loss of data, unauthorised access caused by user negligence, content posted by users, third-party services, regulatory outcomes, property losses or decisions made based on Platform content.

Nothing in these Terms excludes liability where exclusion is not permitted under applicable law.

30. Indemnity

You agree to indemnify, defend and hold harmless Brokket, its directors, officers, employees, consultants, affiliates, partners, licensors and representatives from and against any claims, demands, proceedings, losses, damages, liabilities, penalties, costs and expenses, including reasonable legal fees, arising out of or relating to your use or misuse of the Platform.

This indemnity includes claims arising from your User Content, listings, posts, comments, images, videos, documents, communications, false information, professional conduct, violation of law, violation of these Terms, infringement of third-party rights, property transaction disputes, commission disputes, customer disputes, fraud, misrepresentation, harassment, obscene content or misuse of Circle.

Brokket reserves the right to assume exclusive defence and control of any matter subject to indemnification, and you agree to cooperate with Brokket in such defence.

31. Suspension, Restriction and Termination

Brokket may suspend, restrict, disable or terminate your account or access to any part of the Platform if Brokket believes that you have violated these Terms, provided false information, created legal or safety risk, engaged in fraud, misused content, posted prohibited material, infringed rights, threatened users, manipulated the Platform or acted in a manner harmful to Brokket or the community.

Upon termination, your right to access and use the Platform will cease immediately. Brokket may retain certain information where required for legal, security, audit, enforcement, dispute resolution or legitimate business purposes, subject to applicable law and the Privacy Policy.

Termination does not affect obligations that by their nature should survive, including ownership rights, content responsibility, disclaimers, limitation of liability, indemnity, governing law and dispute provisions.

32. Changes to Platform and Terms

Brokket may update, modify, suspend, discontinue, replace or improve any part of the Platform at any time. Brokket may also revise these Terms to reflect changes in law, business operations, technology, safety practices, user experience or Platform features.

Updated Terms will be posted on the Platform with a revised effective date. Continued use of the Platform after updated Terms are posted constitutes acceptance of the updated Terms.

Users are encouraged to review these Terms periodically. If you do not agree with updated Terms, you must stop using the Platform.

33. Compliance with Laws and Government Directions

Users must comply with all applicable laws, rules, regulations, court orders, government directions, regulatory requirements, RERA obligations, information technology laws, intellectual property laws, privacy laws, consumer protection laws, taxation laws and professional obligations relevant to their use of the Platform and business activities.

Brokket may remove or restrict content, preserve records, disclose information or take action where required by applicable law, court order, government request, law-enforcement request, regulatory direction, safety concern or legal process.

Users must not use the Platform to commit or facilitate unlawful activity, evade legal duties, mislead authorities, conceal illegal transactions, circulate unlawful content or violate public order.

34. Force Majeure

Brokket shall not be liable for any delay, interruption, failure, data loss, service limitation or inability to perform resulting from events beyond its reasonable control, including natural disasters, fire, flood, pandemic, epidemic, war, terrorism, civil unrest, labour disturbance, government action, court order, regulatory action, internet failure, telecom failure, power outage, cyber incident, cloud service disruption, device failure or other similar events.

In such circumstances, Brokket may suspend or modify Platform operations as reasonably necessary.

Brokket may communicate notices through the Platform, email, phone, SMS, in-app notification or other contact details associated with your account.

36. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India, without regard to conflict of law principles.

Subject to applicable law, courts and tribunals located in Faridabad, Haryana shall have jurisdiction over disputes arising out of or relating to these Terms, the Platform, user accounts, User Content or use of Brokket services.

Nothing in these Terms prevents Brokket from seeking interim, injunctive, equitable, protective or urgent relief before any competent court or authority where necessary.

37. Severability and No Waiver

If any provision of these Terms is found invalid, unlawful or unenforceable by a competent court or authority, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

Brokket's failure or delay in enforcing any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Brokket.

38. Entire Agreement

These Terms, together with the Privacy Policy and any other policy or notice expressly incorporated by reference, constitute the entire agreement between Brokket and the user regarding use of the Platform.

These Terms supersede any prior oral or written understandings, representations or communications relating to the Platform, except where Brokket has entered into a separate written agreement signed by authorised representatives.

39. Platform Purpose Statement

Brokket is designed to help real estate professionals connect, collaborate, share information, access knowledge, discover opportunities and improve productivity in a more organised professional environment.

The value of the Platform depends on responsible participation by users. Every user is expected to contribute accurate information, respect other professionals, avoid prohibited content, report misuse and independently verify information before taking business decisions.

By using Brokket, you acknowledge that you are participating in a professional real estate technology platform where trust, lawful conduct and responsible content sharing are essential.

40. Grievance Handling and Safety Response

Brokket may provide channels for users to submit grievances, safety complaints, content reports, intellectual property concerns, account issues or other platform-related requests. Users should provide sufficient details, screenshots, profile references, dates and a clear explanation of the concern so that Brokket can review the matter effectively.

Brokket will endeavour to review genuine complaints in a reasonable and practical manner, subject to the nature of the complaint, information available, legal requirements, user safety, technical limitations and operational capacity. Urgent matters involving unlawful content, threats, child safety, obscene content, fraud or platform security may receive priority review.

The submission of a complaint does not guarantee removal of content or action against another user. Brokket may reject complaints that are incomplete, abusive, false, repetitive, unrelated to the Platform or unsupported by sufficient information.

41. Records, Evidence and Legal Preservation

Brokket may retain records relating to account activity, content reports, moderation decisions, complaints, communications, verification status, technical logs and enforcement actions where reasonably necessary for legal compliance, safety, fraud prevention, dispute resolution, audit, security, support or protection of rights.

Where Brokket receives a lawful request, court order, regulatory direction, law-enforcement request or credible legal notice, it may preserve or disclose information in accordance with applicable law and the Privacy Policy.

Users must not demand deletion, alteration or concealment of information where retention is required or reasonably necessary for legal, safety, fraud prevention or dispute-related purposes.

42. App Store and Mobile Platform Compliance

Users acknowledge that the Platform may be distributed through mobile application stores or operating system providers that have their own rules, technical requirements and review standards. Users must not use the Platform in any manner that may cause violation of such platform rules, including misuse of user-generated content, abusive behaviour, objectionable material, unlawful activity or attempts to bypass moderation and safety systems.

Brokket may take additional moderation, reporting, blocking, filtering, access restriction or safety measures to maintain compliance with mobile platform requirements and to protect the professional character of the Platform.

If a mobile platform provider, device manufacturer, operating system provider or app store requires changes to Platform functionality, availability, content policy or safety controls, Brokket may implement such changes without prior notice.

43. User Acknowledgement

By accessing, registering on, posting to, communicating through or otherwise using the Platform, you acknowledge that you have read these Terms, understood your responsibilities, and agreed to be bound by them.

You further acknowledge that you are solely responsible for your account activity, User Content, professional representations, property information, communications and business decisions made through or in connection with the Platform.
